I have the honour to acknowledge the receip of your despatch No.387 of the 1st September, 1926. submitting your views on the policy of the lengkong Governsent in the matter of land resumption in the New Territories.

With regard to the question of the interpretation of the convention of 1898, i have carefully considered your views in consultation with ay

legal advisers. i am adivised that, from a lagal point of view, the interpretation placed upon it in paragraph 5 of my despatch No.450 of the 26th Koventer 1925 is

the correct one, and that to adopt your version would be to risk an accusation of violating the terms of the Convention. However, for the reasons which you adʼlume, I do not wish to press this interpretation, and i ma

prepared to agree to your proce-ding on the assumption that the Colonial Govement has power to soquire land in the New Territoria for any nublic purpose on payment of a fair price.
